As of September 2026, opening a standard outpatient mental health or substance use disorder (SUD) clinic in Oregon means securing a Certificate of Approval (COA) from the Oregon Health Authority under OAR chapter 309, division 19, not the more intensive licensing path required for IOP, PHP, or residential programs. The dividing line is hours: OHA classifies anything under nine hours of scheduled weekly treatment contact as outpatient (ASAM Level 1.0); nine hours and up is intensive outpatient. Get the level of care right first, because it determines which staffing rules, which application track, and which payer billing codes apply to your clinic.
